It seems to be pretty well accepted that the guy was an Apple employee. Apple have begun legal proceedings to get the phone back too! My favourite bit of trivia is that the guy was in a bar specialising in German beer. To compensate for the fact that he is pretty certain to lose his job, Lufthansa have offered him a flight to a German beer festival!

If he was an Apple employee he must have been pretty high up to be allowed to take prototypes out of a heavily secured room... I reckon there'll be Steve Jobs and maybe 4-5 others who will have that much power.

Of course, it could be Apple themselves, deliberately hyping up the 4G! They've had massive publicity - and possibly even gained $5,000 towards their marketing costs. All by leaving a fake phone in a bar. But Apple wouldn't do something like that would they?
